How Section 69 interest works
- Discretionary but standard: The County Court has statutory power under Section 69 of the County Courts Act 1984 to award simple interest on money debts. While technically discretionary, claiming 8% per annum simple interest is standard civil litigation practice in England and Wales.
- Must be pleaded in your claim: If you do not expressly ask for Section 69 interest in your Particulars of Claim when issuing proceedings, the court cannot award it to you.
- Daily rate formula: `(Debt Amount × 0.08) ÷ 365 = Daily Interest Rate`.
- Continuing daily interest: You are entitled to claim interest not just up to the date of issuing your claim, but continuing at the same daily rate up to the date of final judgment or earlier payment.
